Estate Administration

The process of winding up the estate of a loved one who has passed away needs to be handled with empathy and compassion.

We offer to be involved as much or as little as you would like in the process of establishing the extent of an estate, reporting to HMRC for inheritance tax purposes, applying for Confirmation of Executors, and carrying out the terms of any Will that has been left.

Estates come in all shapes and sizes but the process for dealing with the administration usually requires the following steps to be considered:

  • Establish whether the deceased left a Will and confirm the terms, e.g. who has been appointed as Executor with the power to wind up the estate and who are the beneficiaries of the estate. If no Will has been left, the laws of intestacy in Scotland will apply.
  • Establishing the extent of an estate, e.g. what assets and liabilities did a deceased leave. This can be anything from a house, bank accounts, policies, shares, cars, jewellery and any outstanding mortgages, credit cards, personal loans etc.
  • Establishing the value of the deceased’s estate and reporting any inheritance tax due to HMRC.
  • Arrangements for settling debts, taxes and Legal Rights before distributing the estate in terms of either a Will or the laws of intestacy.
